DescriptionGinger B. LaChapelle is the co-chair of Blitman & King’s Employee Benefits Practice Group and chair of the Cybersecurity Law Practice Group. She has broad experience counseling sponsors of multiemployer and single-employer plans, companies, tax-exempt entities, and executives on all matters of tax, ERISA, and cybersecurity and data breach protection compliance. Ginger also regularly advises public plans on compliance with applicable state and federal laws. Ginger advises on the design, operation, and applicable qualification requirements of all types of retirement and welfare benefit plans including compliance with HIPAA/HITECH, the Affordable Care Act, COBRA, FMLA, USERRA, MHPA/MHPAEA, PPA, and Internal Revenue Code compliance (including with sections 457(f) and 409A).She is a frequent public speaker on wide range of employee benefits plan related topics, including cybersecurity, compliance with federal mandates, and investment fees and expense. Ginger also has significant experience handling ERISA controversies including benefits litigation and governmental investigations. She has represented plan fiduciaries in breach claims, benefit plan overpayment recovery litigation, and in U.S. Department of Labor investigations alleging statutory violations. She has also handled audits conducted by the Internal Revenue Service. Ginger is a member of the IFEBP’s Affordable Care Act Expert Panel, a contributing author of the ABA Section of Labor and Employment Law’s treatise, Employee Benefits Law, Union Co-Chair of the Regulation of Specialized Types of Retirement Income Plans subcommittee of the American Bar Association’s Joint Committee of Employee Benefits, and the ABA Joint Committee of Employee Benefits co-liaison (scrivener) to the Department of Labor, and a member of the HHS Health Sector Coordinating Council Cybersecurity CSA 405(d) Task Group.
