Description | Thomas Ercolano III, Esq. is a family law attorney with Weinberger Divorce and Family Law Group, LLC. Mr. Ercolano is an accomplished family lawyer and former Deputy Attorney General (DAG) with the New Jersey Office of the Attorney General. He is highly skilled in all aspects of family and matrimonial law, including divorce, custody and parenting time, alimony, child support, division of assets, qualified domestic relation orders (QDROs), domestic violence, DCP&P child welfare matters, modification and enforcement of family court orders, post-divorce issues and all other related family matters. Recognizing that divorce and family law cases are rarely straight forward, Mr. Ercolano guides his clients with attentive care, service and sensitivity. He develops deep and strong connections with his clients, taking the time to discuss any and all issues while maintaining open communication and availability. By guiding and keeping his clients informed at every major decision in their case, Mr. Ercolano’s clients have the confidence and peace of mind of knowing they are on the best path forward. Mr. Ercolano will always seek out low conflict resolutions whenever possible and appropriate, including mediation; however, should litigation be necessary, he will zealously advocate to safeguard his clients’ rights and best interests. Drawing upon his vast courtroom experience, Mr. Ercolano is known for his deft touch and ability to anticipate and effectively respond to his adversary’s challenges and counter arguments while interacting with the Courts, and ultimately persevering in achieving his clients’ goals. Before entering private practice, Mr. Ercolano spent almost five years in public service as a Deputy Attorney General (DAG) with the New Jersey Office of the Attorney General. As a DAG, he prosecuted child protective services matters in the New Jersey Superior Court, conducting Order to Show Cause custody hearings, case management conferences, pre-trial conferences, child abuse and neglect fact-findings, and termination of parental rights trials. Mr. Ercolano also worked with expert witnesses including child abuse pediatricians and psychologists in the course of the DCP&P investigations and litigation. In addition to his trial advocacy, he also wrote appellate briefs and presented oral arguments before the Appellate Division. In his family law practice, Mr. Ercolano recognizes that oftentimes clients are dealing with other legal matters such as criminal charges, child welfare investigations, real estate matters, employment disputes, or estate planning. Mr. Ercolano’s extensive experience in these areas while in private practice enables him to comprehensively and effectively protect his clients because he understands how issues in different areas of the law can impact a family law case. Mr. Ercolano’s greatest life event occurred with the birth of his son because it opened his eyes to the power and importance of a parent’s relationship with their child. This has provided an entirely new perspective on the services that Mr. Ercolano provides his clients and allows him to fully grasp the importance of his clients’ motivation and objectives in safeguarding their rights to their children. Mr. Ercolano graduated from Lafayette College and then Seton Hall University School of Law. He began his legal career as a judicial clerk to the Hon. Roger W. Daley (retired) in the Middlesex County Family Court. During his clerkship, Mr. Ercolano quickly learned that family law cases are the most important matters before the Court they have the highest stakes and deal with the most consequential issues. At that point, he knew he wanted to pursue a career in family law to help his clients during their most challenging times. The clerkship also provided valuable insight into how to navigate a courtroom and how judges evaluate cases, consider evidence, and make decisions tools which Mr. Ercolano finds invaluable when advocating for his clients in the courtroom. Mr. Ercolano is admitted to practice in New Jersey, New York, and the federal District Court of New Jersey. He is also a member of New Jersey State Bar Association and the Morris County Bar Association. When he is not in the courtroom or at the office, Mr. Ercolano enjoys spending time outdoors with his wife, son, and rescue dog. |
