Description | Sue has more than 10 years of experience representing industrial development agencies (IDAs) and local development corporations (LDCs) in public finance transactions throughout New York State. She represents her clients in connection with the issuance of tax-exempt and taxable obligations as well as representing IDAs on straight lease transactions. Sue advises her clients on a wide variety of issues including the General Municipal Law, the Public Authorities Law and the latest pronouncements and audit findings of the NYS Authorities Budget Office. Sue counsels IDAs in analyzing projects under the General Municipal Law and in conjunction with the granting of benefits in the form of exemptions from real property taxes, State and local sales and use taxes, and mortgage recording tax. Sue also counsels her clients on compliance with the Public Authorities Law and the reporting requirements mandated thereby. Sue’s work as bond counsel provides her the opportunity to facilitate the issuance of tax-exempt and taxable revenue bonds that provide financing for construction and equipping of educational facilities, healthcare facilities, affordable housing complexes, manufacturing facilities, as well as commercial facilities. These financings range from $50,000-$326 million. In her capacity as bond counsel, Sue was involved with the first ever Qualified Green Building and Sustainable Design Project in the country under IRC Section 142 relating to exempt facilities. This green building financing in 2007 involved the issuance of $228 million of tax-exempt bonds for a regional shopping center located on a brownfield site. These bonds were PILOT revenue bonds, with the payment of principal and interest to be made by the IDA from payments in lieu of taxes. Aside from the foregoing, Sue spent years as General Counsel to the Trustee in a Chapter 11 bankruptcy proceeding venued in the Northern District of New York, involving the largest Ponzi scheme in U.S. history at the time. |
